Terms of Service

1. Agreement to Terms

By accessing or using the TINEK website (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Site.

These Terms apply to all visitors, users, and anyone who accesses or interacts with the Site, including those who submit their email address or other information through any form on the Site.

TINEK LLC ("TINEK," "we," "us," or "our") operates the Site. TINEK is an Oklahoma limited liability company.

2. Description of the Site

The Site is currently operating as a pre-launch marketing and informational website for a hunting-related web and mobile application under development. The Site's current purpose is to:

  • Provide information about the TINEK application and brand
  • Allow users to sign up with their email address for early access consideration and launch updates
  • Share promotional offers associated with the anticipated launch

The Site is not currently a functional software platform, subscription service, or storefront. No purchases, payments, or account registrations are being processed at this time.

3. Early Access Signup

By submitting your email address through the Site, you acknowledge and agree to the following:

  • Submission of your email address does not guarantee early access, product access, a subscription, or any purchase rights.
  • Email signups are for informational and promotional communication purposes only.
  • TINEK may use your email address to send you launch updates, early access notifications, and promotional offers, including a 10% off promotional launch offer (described in Section 4).
  • You may opt out of these communications at any time using the unsubscribe link included in any email we send.

4. Promotional Offer Disclaimer

TINEK may present a promotional offer, including a 10% discount in connection with the anticipated product launch ("Promotional Offer"). Regarding this offer:

  • The Promotional Offer is promotional in nature and is subject to change, modification, or cancellation at any time without notice.
  • The Promotional Offer does not constitute a binding contract, guarantee of pricing, or commitment to make any product, subscription, or service available at any particular time or price.
  • Signing up with your email does not lock in, reserve, or guarantee the Promotional Offer or any specific pricing.
  • Final terms, conditions, eligibility requirements, expiration dates, and restrictions of any promotional offer will be communicated at the time of launch or purchase.
  • TINEK reserves the right to modify the discount percentage, eligibility criteria, or discontinue the offer entirely prior to or at launch.

5. No Guarantee of Launch, Features, or Availability

TINEK is actively developing its application and services. We make no representation or guarantee regarding:

  • The timing of any product, app, or service launch
  • The features, functionality, or availability of any future product or service
  • Whether any specific feature described or implied on the Site will be included in a final product
  • Pricing, subscription tiers, or fee structures for any future product

Launch timelines, feature sets, and availability are subject to change at TINEK's sole discretion.

6. Future Products and Services

TINEK may, in the future, offer or expand into one or more of the following:

  • Web and mobile software applications and subscriptions
  • Merchandise and outdoor products
  • Hunting technology, trail cameras, and related hardware
  • Analytics, mapping, sighting tracking, and other hunting-related features and services

These Terms are intended to apply broadly to your use of the Site. Future products and services may be subject to additional or separate terms of service, billing agreements, subscription terms, cancellation policies, and refund policies, which will be provided at the time of purchase or enrollment. Nothing in these Terms creates any obligation for TINEK to offer, deliver, or maintain any specific product or service.

7. No Hunting or Outcome Guarantees

Any information, descriptions, features, or capabilities discussed or implied on the Site relating to hunting, wildlife, analytics, mapping, or related outdoor activities are for informational and illustrative purposes only.

TINEK makes no warranty, guarantee, or representation that:

  • Any future app features, analytics, predictions, or insights will produce real-world hunting results or success
  • Any data, recommendations, or information provided through future products will be accurate, complete, or actionable for any specific location, species, season, or condition
  • Use of TINEK products or services will result in a harvest, encounter, or any other hunting outcome

Hunting involves inherent risk, uncertainty, and variables beyond any technology's ability to predict or control. Users are solely responsible for their own decisions, actions, and compliance with all applicable hunting laws and regulations.

8. Intellectual Property

All content on the Site — including but not limited to the TINEK name, logo, brand identity, trademarks, service marks, trade dress, graphics, text, images, icons, design elements, page layouts, and all other materials — is the exclusive property of TINEK LLC or its licensors and is protected by United States copyright, trademark, and other intellectual property laws.

You may not, without prior written permission from TINEK:

  • Copy, reproduce, distribute, republish, or transmit any portion of the Site or its content
  • Modify, adapt, create derivative works from, or reverse engineer any content, software, or branding associated with the Site
  • Use the TINEK name, logo, or branding in any manner that implies endorsement, affiliation, or sponsorship
  • Use any TINEK content for commercial purposes

Limited, personal, non-commercial use of the Site for its intended informational purpose is permitted. All other rights are reserved.

9. Prohibited Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable law or regulation
  • Scrape, crawl, spider, or automatically extract data from the Site by any means
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of any software associated with the Site
  • Submit false, misleading, or fraudulent information through any form on the Site
  • Impersonate TINEK, any TINEK employee or representative, or any other person or entity
  • Transmit or upload viruses, malware, harmful code, or any content that could damage, interfere with, or disrupt the Site or its infrastructure
  • Interfere with, overload, or attempt to gain unauthorized access to the Site or its underlying systems
  • Use the Site to harvest email addresses or contact information of other users
  • Use the Site in any way that could damage TINEK's reputation or business

TINEK reserves the right to terminate or block access for any user who violates these prohibitions.

10. Disclaimers and No Warranties

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TINEK DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WARRANTIES THAT THE SITE WILL BE AVAILABLE, UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS
  • WARRANTIES AS TO THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT ON THE SITE

Your use of the Site is at your own risk.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TINEK LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL TINEK'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF THE SITE EXCEED ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

12. Third-Party Links and Services

The Site may contain links to third-party websites or reference third-party products and services. These links are provided for convenience only. TINEK does not endorse, control, or assume responsibility for any third-party content, services, or practices. Your use of any third-party site is governed by that site's own terms and policies.

13. Changes to the Site and Terms

TINEK reserves the right to:

  • Modify, update, suspend, or discontinue the Site or any portion of it at any time without notice
  • Update these Terms at any time

If we make material changes to these Terms, we will update the effective date at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

14. Termination and Access

TINEK may, in its sole discretion, restrict, suspend, or terminate your access to the Site at any time and for any reason, including violation of these Terms, without prior notice or liability to you.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved in the state or federal courts located in Oklahoma, and you consent to the personal jurisdiction of such courts.

16. Indemnification

You agree to indemnify, defend, and hold harmless TINEK LLC and its members, officers, employees, agents, and service providers from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any applicable law or third-party rights.

17. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms provided in connection with specific products or services, constitute the entire agreement between you and TINEK LLC with respect to your use of the Site and supersede any prior agreements.
